1. CONTEST DESCRIPTION: The Sonder Memories Contest (“Contest”), hosted by Sonder Hospitality USA Inc. (https://www.instagram.com/sonderstays/?hl=en) (“Sonder”), begins December 12, 2023 at 12:00 p.m. ET and ends on December 15th at 11:59 p.m. ET (the “Promotion Period”). Sonder will begin collecting Submissions for the Contest starting at 12:01 a.m. ET on December 1, 2023 until 11:59 p.m. ET on December 7, 2023 ET (the “Submission Period”), as described in greater detail below.
By participating in this Contest, each entrant (“you”) unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of Sonder, which shall be final and binding in all respects. Sonder is responsible for the collection and/or processing of Submissions and the overall administration of the Contest. 2. ELIGIBILITY: This Contest is open to US residents who are aged 18 years or older (or, if higher, the legal age of majority in the US state in which they reside). Sonder and its parents, subsidiaries, affiliates, employees, directors, and members of their immediate family (spouse, parent, step-parent, legal guardian, sibling, step-sibling, child, step-child, and their respective spouses, regardless of where they reside) and persons living in the same household of such persons, whether or not related, are not eligible to enter or win. This Contest is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.
3. HOW TO ENTER: To enter the Contest, (i) share a photo or video of your favorite memories at a Sonder property on Instagram via in-feed posting or stories tagging both @sonderstays and #SonderMemories and (ii) send the photo or video directly to @sonderstays in DMs (each, a “Submission”). The hotel or accommodation featured in your entry must be a hotel or accommodation managed by Sonder or the Submission will not be eligible. Submissions must be received by Sonder during the Submission period to be entered into the Contest.
Submissions may not include obscene, offensive or inappropriate (in Sonder’s sole and absolute discretion) material or defame any person, or otherwise infringe on any person’s proprietary rights. If you are posting a photograph, you must have permission from the photographer (or be the photographer yourself) and have permission from any persons who appear in the photo before submitting it.
There are no restrictions on the number of Submissions you can enter into the Contest.
4. WINNER DETERMINATION: After the Submission Period, the Sonder brand team will select the five (5) the most creative Submissions from among all eligible Submissions received during the Submission Period. Sonder will not disclose judging scores for Submissions. Sonder reserves the right to select fewer than five (5) Submissions if it does not receive a sufficient number of eligible and qualified Submissions.
If your Submission is selected by the Sonder brand team it will be published in a Contest carousel on December 12, 2023 starting around 12:00 p.m. ET. The Submission that gets the most comments during the Promotion Period will win.
5. PRIZES: One (1) winner (the “Winner”) will receive a free 3-night stay for 2 people at a Sonder property located in one of the cities displayed in the Contest carousel. All stays are subject to black-out dates and availability alongside city team approval.
No cash or other prize substitution shall be permitted. The prize is non-transferable and must be redeemed in 2024.
Please note that all prizes are based on fair market value at $599 or less. The Winner is responsible for reporting the prize as income. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. Failure to comply with these Official Rules will result in forfeiture of the prize.
6. WINNER NOTIFICATION: Sonder will notify the Winner via Instagram directly after the vote is complete. The Winner must accept the prize by contacting Sonder directly via Instagram DM as directed by Sonder within thirty (30) days of notification. If the Winner does not contact Sonder by DM within thirty (30) days of notification they will be disqualified and will forfeit the prize, and Sonder reserves the right to select an alternate winner from among the remaining eligible Submissions. Sonder is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or the Winner’s failure to adequately monitor any account.
Any winner notification not responded to or returned as undeliverable may result in prize forfeiture.
7. PRIVACY: Any personal information supplied by you will be subject to Sonder’s privacy policy: https://www.sonder.com/privacy-policy. By entering the Contest, you grant Sonder permission to use your email address and any other personally identifiable information for the purpose of administration and prize fulfillment, including use in a publicly available winners list.
8. CONSENT TO USE SUBMISSIONS: By participating in the Contest, you consent to the use of your username and Submission for advertising and promotional purposes without additional compensation, including on Sonder’s social media profiles (except where prohibited by law).
9. SOCIAL NETWORK DISCLAIMER: This Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. Any questions or comments regarding the Contest should be directed to Sonder, not Instagram. You understand that you are providing your information to Sonder and not to Instagram. By participating in this Contest via the Instagram platform, you are also subject to Instagram’s data policy and terms of use, which can be found at https://privacycenter.instagram.com/policy/?entry_point=ig_help_center_data_policy_redirect and https://help.instagram.com/581066165581870 .
10. SONDER DISCLAIMER: By entering the Contest and/or accepting the prize, you agree that Sonder, Instagram and their respective parent companies, assigns, subsidiaries and affiliates, and advertising, promotion and fulfillment agencies and all of their respective employees, officers and directors will have no liability whatsoever, and will be held harmless by entrants for any liability for any injuries, losses, or damages of any kind to person and property resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse, or use of the prize, or participation in the Contest. Any dispute arising from the Contest will be determined according to the laws of the State of California, including the procedural provisions of those laws, with giving effect to any choice of law or conflict of law rules. By entering this Contest, you agree to consent to the jurisdiction of the courts of California, sitting in the City and County of San Francisco, for the determination of any matter or dispute arising under or in respect of the Contest.
11. TERMINATION OR SUSPENSION OF THE CONTEST: Sonder reserves the right to cancel, terminate, modify or suspend the Contest or these Official Rules, either in whole or in part, with or without notice.
12. WINNER LIST/RULES: To obtain a copy of the winner list or a copy of these rules, send your request along with a stamped, self-addressed envelope to Sonder Hospitality USA Inc., 447 Sutter Street Suite 405 #542, San Francisco, CA 94108, Attn: Sonder Memories Contest. Requests for the name of the Winner must be received no later than thirty (30) days after the Promotion Period has ended.
